Early in the last century, Chinese labor law had been made especially for workers rest and vacation provisions. However, with the development and changes of the economic systems, Chinese enterprises in the form of diversification, social labor holiday system has also undergone a series of questions. Holidays institutional problems of contemporary research workers is not only the protection of workers’rights, the core can be considered as social workers of different levels of distributive justice issues. To solve the key point of labor holiday system is not limited to Labor rights, also from the Chinese labor system as a whole vacation starting properly coordinated relationship between fairness and efficiency.In view of the health of workers leave system involves the right to rest the right to liberty, the right to employment, the right to development, and many other rights, thus improving the system of workers leave for workers, the community, the nation and the international human rights protection are particularly important. Based on this condition of social construction of distributive justice, the empirical research, and workers leave the system through the related concepts, history, values, and other aspects of the substance of theoretical research, reflection stage system of Chinese labor holidays and legal problems in practice, by comparing the labor dispute settlement mechanisms in other countries, thus the system can still explore the Chinese labor holiday perfect.
