| Property management as a new industry along with the rapid development of real estate economy and gradually formed its own industry. The rise of the commercial housing development and urban districts of realty service put forward higher request, but as a result of property management in China starts late, the related legal system is not perfect, property management disputes have occurred, the property management limited laws and regulations. Practice of residential property management disputes happen, greatly affect the quality of life of the owners of the community. In this paper, based on the current research on the legal issues existing in the property management in our country, on the basis of the existing property management theory, the property management practice in our country through the analysis of the property management legislation of our country and combining with the foreign property management legislation, to highlight the problem of property management in our country to perfect the idea for the legislation of property management in China. Expectations for the improvement of the system of property management legislation have certain reference significance.This article is divided into four parts, the first part is the theoretical basis for property management, mainly introduces the basic knowledge of property management and property management in our country. Legal issues highlighted in the second part is our country’s property management’s analysis, this part is the core of the full text, mainly from the definition of residential parking space ownership, residential property fee and property management legal relationship of several aspects to analyze the problems existing in the property management in our country and its causes. The third part is outside of the property management system. Compared with legal system of property management in our country, the legal system for foreign development earlier is relatively perfect, for the perfection of property management in China has a great significance. The fourth part is some idea of the construction of legal system of property management in our country. Through the second part of the analysis of the legal problems of the property management system in China and the three parts of study abroad, on the basis of the basis on the practice of property management in our country draw lessons from foreign good system, the perfection of legal system of property management in China, points out several ideas to themselves. |
