| Overseas investment is an important part of a country’s integral international investment. At different stages of development of national economic, the policies of a country’s treatment of overseas investment should be different. China’s overseas investment began in1979, with the deepening of economic globalization and China’s reform and opening up of constantly increased, China’s overseas investment has developed more quickly. However, as an important means of norming and adjusting the behavior of of overseas investment-the legislation of overseas investment in our country still has many problems and shortcomings.Therefore, this article analysises the problems of the legislative system at the macro level and micro level of the China’s overseas investment legislation. Firstly, it talks about the concept of legal protection of overseas investment, and then comes to the understanding of the current situation and problems of China’s overseas investment legislation; Secondly, it introduces the world’s overseas investment legislation in other countries, and we learn the valuable experience from them; Finally,it talks the problems and deficiencies of China’s overseas investment legislation from the beginning stages of legislative approval of overseas investment, the overseas investment promotion legislation, the regulation of the overseas investment legislation, to the overseas investment protection monitoring system for the solution, which are the construction of system-related legislative proposals of overseas investment in China, and in order to put forward to improving the overseas investment’s basic law in all directions. |
