Studies On Chinese Legal System Of The International Copyright Trade

Copyright trade, especially international copyright trade, is of great significance not only to the exercise of the author’s legal rights and interests, but also to advancement in copyright industry. In addition, copyright trade has made contributions to international exchange and cooperation in culture, education and science and technology, mutual understanding between nations, and human civilization progress. Since China’s access to the Berne convention and Universal Copyright Convention in1992, especially after its entry into the WTO, trade in copyright between China and other countries is getting more and more prosperous and the scale of cultural international exchange is getting larger and lager. But foreign copyright trade is still a relatively new field. With the rapid development of international copyright trade, there are many serious problems have taken place in the past several years. Analyzed these questions, we found that the ultimate measure to resolve these questions is reinforce the related law construction. Through analytical study the problems about the law construction of international copyright trade, my thesis try to find out some measures to resolve these questions, and to promote the development of international copyright trade in China in a new situation.This essay deals with "Studies on China’s legal system of the international copyright trade. It by means of the approach of historical analysis and comparative analysis, expounds the historical origin and developing course of international copyright trade; explores its legal meaning and basic features; comments on its primary principles, condition and its main styles. This article presents an overall introduction to internal law protection and external law protection system in international copyright trade. It comparatively analyzes law application problems; deeply dissects the current situation, features and the present difficulties and problems relating to international copyright trade in China; briefly evaluates China’s present law system concerning external copyright trade; finally, this essay particularly puts forward some legislative proposals perfecting external copyright trade in China.
