’’Internships" is a concept proposed in the process of higher occupation education development and reform which is accompanied by social economic development required in China. It’s a kind of innovation of the occupation education system."Internships" has become one of the leading personnel training mode of higher vocational education. Meanwhile, the protection of students’ legal rights and interests has become a problem urgently needed to be solved during internships.This article is based on protecting the rights and interests of higher occupational students’internships in China, which analyzed the legal relations among higher occupation colleges, trainees and practice units, so as to further clarify the legal status of trainees and the higher occupation colleges’ duty in protection of internship students, many problems exist in internships between students and Higher Occupation Colleges in China have been pointed out:1. The lack of legal protection of legal system of internships currently;2. For the existence of trainee management system problems in colleges, each higher occupation colleges will formulate corresponding regulations in the "Student Manual", which are mainly base on the constraints and requirements for students during the internship. And for the problem of protecting the rights and interests of the trainees appeared in the internship are not mentioned.3. Awkwardness will occur once the labor remuneration, labor time, accidental injury and so on bring the dispute during internships. It will also bring some difficulties to the law enforcement departments, resulting in causing some puzzling problems while protecting student rights.4. Occupation colleges lack of rights to education and other issues necessary to students before practice and practice process.Therefore, this article is aiming at the specific practice of higher occupational Students’ internship rights and interest protection problems which causing the students in a relatively weak position while legal rights cannot get effective guarantee. It views from higher occupation colleges, emphasizing on students’internships process:Higher occupational colleges should play some roles:1. From the problem of the lack of perfect internship agreement signed to make up the legal system, so as to further clarify the responsibilities of all parties;2. Supporting the development of practice management regulations, for all kinds of problems students may appear to be clear;3. To strengthen the ideological education for students, improve the legal awareness of students, making students known how to safeguard their own legitimate rights and interests by legal means. In addition, the choice of a good practice to realize the socialization of liability insurance, the practice of Higher occupational Colleges and internship units, alleviate the pressure, to further promote the development of higher occupation colleges internships, provide more excellent quality, skilled occupation personnel for the society, and further promote the development of our society and economy.
