Prison Punishment Execution-on The Reform And Perfection Of The System Of Commutation And Parole

The execution of prison punishment for criminals occupies the last part of criminal action procedures. Its importance can be manifested not only by the necessity in criminal proceedings but also by its vital role in achieving the penalty function. Whether the execution of punishment is legitimate and appropriate has a direct relation with the completeness of criminal action procedures and it ensures the guarantee for punishing criminals and protecting the legal citizens.Prison in our country is the executive branch of penalty. Based on the provisions of Criminal Law and Criminal Procedure Law, those criminals who are sentenced to death with two-year reprieve, life imprisonment or fixed-term imprisonment shall receive their penalty in prison. The prison bears the role of giving full play of its punishment and incentive function through the application of punishment, ideological education and labor reform. Therefore, the criminals in prison can abandon their evil and promote goodness, study law, correct bad habits, eradicate the criminal roots and finally become a legal citizen again. The accurate, fair and civilized penalty execution plays a significant role in promoting criminals’reform initiatives as well as protecting their human rights, manifesting law authority, achieving penalty benefits, highlighting social progress and enhancing social harmony. Aiming at better carry out the penalty execution, this paper conducts a thorough research and debate on sentence commutation and parole, especially a deep investigation of sentence commutation.This paper firstly introduces some concepts related with penalty execution and then through the investigation of some prisons in Tianjin, collects relevant data, analyzes the already existing problems in penalty execution and offers some suggestions. Next, the writer centers around the research of sentence commutation and parole-the key contents in penalty execution, and based on working practice and communication with colleagues, come up with some thoughts and suggestions about the problems involving the sentence commutation, parole and granted penalty execution outside prison. Finally, The writer earnestly hopes the thoughts and suggestions could help facilitate and improve the penalty execution.
