Transportation Administrative Legislation Assessment Research

Since reform and opening up, china’s legislative work of Transportation has improved a lot, nearly solving the state of lacking relevant references, which resulted in the law-based administration. After central government’s Super Ministry System Reform, the transportation management field and the law enforcement have all been expanded, which requires higher request and responsibility for the transport administrative department. As a result, how to strengthen legislative supervision as well as promote legislation based on the cost of legislation’s what is we are confronted with. International legislative evaluation demonstrates that evaluating the ongoing projects by a uniform evaluation system is the optimal way to improve legislation quality, transportation industry, institution-building of legislation evaluation,Since the issue of guideline for post-legislation evaluation by the Ministry in2009, the relevant studies have been carried out with the industry, resulting rich experience. However, the evaluation standard isn’t comprehensive enough and there has been no unified regulations. As well, the measures to supervise and guarantee the implementation are not available, which results in inactive, indifferent and negative states among some institutions.The paper involves the theory of transportation legislation evaluation and summarizes the status in quo about transportation legislation. And based on some cases, home and abroad, we put the key point on how to build up the optimal legislation evaluation system adapted to transportation industry. The introduction explains why the present title as selected briefly, and the recognition extent to legislation by the Ministry of Transportation as well as the status in quo about implementing legislation evaluation. The main body consists of four sections as follows:1. Introduction of relevant theories on the legislation evaluation, including the understanding of some relevant concepts involved in legislation evaluation and the summary of some general and professional features and the significance of the legislation evaluation;2. Summary of the status in quo about transportation legislation evaluation domestically and the trouble involved in the evaluation work to further norm and improve the evaluation system.3. By the introduction and analysis of overseas and domestic legislation evaluation cases, we summarized their pros and cons to build up a platform for us to study and exchange accordingly.4. Attempt to build up the legislation evaluation system adapted to transportation industry. The system involves the main body, the object, the standard, the methods and the steps etc. By building up a comprehensive, systematic and scientific legislation evaluation system, regulating the implementation and management of evaluation system and promoting institutionalization and legislation of the evaluation work in transportation industry.To promote transportation industry management legislation evaluation work formalized and legalized.
