Study On The System Of Before-legislation Evaluation Of Chinese Local Legislation

With the advancement of national legal system,the Communist Party and the government have been paying more attention on legislation quality.Especially after the 18 th congress of the Communist Party of China,legislative evaluation,one of the significant solutions to improve legislation quality plays a greater role.However,comparing to formed System of Post-legislation Evaluation,the System of Before-legislation Evaluation of our country,especially the local system have been a little weaker.Thus,investigating and establishing a more effective Local System of Before-legislation Evaluation are of great significance to improve legislation quality.Chapter one is introduction.The background of this topic,research significance,research status at home and abroad,purpose of this paper and research methods are discussed.Chapter two is an overview of local Before-legislation evaluation system.This chapter regards the entire local system of legislation evaluation as a starting point to analyze several related concepts of the local legislation evaluation comparatively,in order to clarify the connotation and characteristics of the local Before-legislation evaluation system,and analyze the necessity of the system.Chapter three is the analysis on status,problems and causes of local Before-legislation evaluation system.The practice on Guangdong Provincial People's Congress Law Committee of Guangdong province of "West River Protection Ordinance(Draft)" has been taken as an example to have a further research.Investigating and analyzing the problems and causes of the local Before-legislation evaluation system from the perspectives of evaluation subject,evaluation criteria,evaluation procedure and evaluation methods of the current situation have been discussed.The fourth chapter of this paper is to draw lessons from the mature Before-legislation evaluation system of foreign countries.This chapter will summarize the development and the main contents of the Before-legislation evaluation system both of the United States and Japan,which may be a reference for the development of local Before-legislation evaluation system in china.The last chapter is some suggestions on the current status of local Before-legislation evaluation system.Combined with the practice at home and abroad,the author put forward some suggestions to contribute on the systematization and standardization of local Before-legislation evaluation system in China.
