Research On Perfecting Legislation Of Green Transportation

Green transportation refers to the application of one kind or multiple kinds of means of urban transportation that is high-speed and suitable for urban environment with low pollution to realize the movement of people and objects and the application of these means of transportation to complete the transport system formed by society and economic activities. It emphasizes multi-coordination of urban environment, low energy consumption, low pollution and saving construction and maintenance cost. Particularly, it includes:1.green standards for motor vehicles:low pollution, emission reaching the mark, using clean fuel and improving technologies; 2.green standards for traffic regulations:including green modes of transportation, namely promoting pedestrian traffic, bicycle traffic, public traffic (consists of traditional bus system, bus rapid transit, advanced public transportation system, such rail transits as light rail and subway); attach importance to establishing right-of-way system that gives priority to pedestrian, bicycle, bus and track traffic, actively promoting public traffic and reducing the trip-sharing rate of motor vehicles, especially the automobiles; paying attention to the establishment of parking lot regulation; 3.green standards for roads:no block up, rational arrangement of road structure.Green transportation has been put forward with the background of various problems such as serious urban environment pollution, impaired life and health property of citizens and blocked traffic due to wide use of automobiles. Green transportation is a kind of people oriented and advanced traffic theory with sustainable development and foresight. Its concept has been widely adopted by developed countries. At present, urban traffic guidance in our country is short of the contents about green transportation and the relevant laws and regulations are of deficiency and distemperedness. It can be mainly reflected by:existing problems in vehicle exhaust treatment as well as no fine sorted standards, excessive discretionary power, overlooking the administrative law enforcement entity of traffic police; no comprehensive contents and no very definite regulations on vehicle noise treatment in green standard legislations of motor vehicles; lack of proper regulations on pedestrian traffic, bicycle traffic, public traffic and car for public affairs from the aspect of traffic regulations; locating ambiguity of green road standards. Therefore, it is necessary to strengthen and perfect the laws in respect of green transportation in our country. As to content, it is necessary to enrich and perfect the laws and legislations of green motor vehicles and green roads, as well as green transportation regulations, green transportation installations and facilities and public traffic. As to legislative mode, it is appropriate to modify and perfect the existing laws and legislations instead of abolishing the old ones and making a fresh start. As to regulatory instrument, it is essential to use the method of force, lead, encouragement to ensure green transportation.In the introduction, the thesis puts forward the problems, writing intention, background and the structure of the thesis.
