With the rise of third-party payment market, prepaid consumption has beenthroughout our daily lives and provides us with a more extensive service offerings.But when we are enjoying great convenience our commercial prepaid cards brought tous, increasingly prominent judicial dispute also gave us a wake-up call. It exposedthe lack of fatigue-related and regulatory regime. Therefore, mainly through casestudies and comparative research methods to sort out this article typical case on thecurrent judicial practice, tease out the focus of the dispute, in order to find the perfectpath.Chapter Ⅰ,analyzed the current legislation from a macro perspective, mainlyfrom three different levels of legal regulation sort of legislation. There are some gapsin the legal aspects of legislation and regulations, and for the regulation of prepaidcards departmental rules embodied in the field, while a programmatic document of thecentral agencies and local industry associations, also the issue of different levels ofregulation. Therefore, by combing the existing legislation, the reader can be faster onthe legislative commercial prepaid cards have a more comprehensive understanding.At the same time I will compare it with the Securities and characterized as asettlement tool, bond certificates, financial instruments and have marketing toolattributes to make relevant recommendations to improve theoretical foundationbelow.
