Study On The External Supervision Mechanism Of State-owned Enterprises

State-owned enterprises as microscopic carrier of our state-owned economy, play a leading role in the national economy in our country, but because of the particularity of the state-owned enterprises, state-owned enterprises no matter adopt what kind of business model, always can’t avoid the problem of separating the owners and managers. Therefore, the supervision mechanism of state-owned enterprises is particularly important. At present, on the basis of the supervision main body is different, the domestic scholars to the state-owned enterprise supervision is divided into internal and external supervision. But in terms of the external supervision of state-owned enterprises, research is not comprehensive. Because of this, the writer first from the basic concept of state-owned enterprise supervision, determine the external supervision and internal supervision of the state-owned enterprises relate to each other, to clarify the meaning of the state-owned enterprise external supervision. As for the content of the external supervision of state-owned enterprises, it depend on the source of the supervision power, mainly from four aspects. First of all, from the national public power supervision of administrative supervision, this paper discusses the nature of the administrative supervision and its difference with sponsor duties organization regulation, straighten out the administrative supervision and the theory basis of state-owned enterprises, state-owned enterprises were discussed and the related content of legal system of administrative supervision and the existing shortcomings, puts forward the corresponding perfecting suggestion. Secondly, from the perspective of the national public power of the National People’s Congress supervision, analyzes the present situation of the National People’s Congress supervision of state-owned enterprises and to clarify the theoretical basis of the National People’s Congress supervision, the supervision and commentary about the way of how to choose the people’s congress and improving Suggestions and insufficient of the current National People’s Congress supervision. Moreover, from the national public power supervision of the judicial supervision of the judicial supervision, divided into the trial supervision and procuratorial supervision, respectively, its insufficiency, and puts forward the improvement of the related Suggestions respectively. Finally, from the social supervision of national public power system, this paper discusses the characteristics of the social supervision of state-owned enterprises, methods, problems of social supervision, and the improvement of the related Suggestions are put forward.
