The Investigation On The Neghborhood Disputes Criminal Offence

"Criminal offences caused by the neighborhood dispute" has became to a problemconcerned by society day by day. At present, China is in an important period of economic andsocial development, with various contradictions emerging, especially the contradictions anddisputes among the neighborhood which keeps growing inhibits the economic developmentand social harmony seriously. What the Neighborhood disputes destruct is not only the socialsecurity, but also the traditional morality, which is running in the opposite direction of thecurrent call for building a harmonious society, has became the obstacle of the socialdevelopment. Basing on A County of Guizhou Province, the writer is trying to investigatecomprehensively the neighborhood disputes-type criminal offence, which is based on ACounty People’s Court’s judgments concerning the criminal offences caused by theneighborhood disputes since2008, the writer is trying to get a solution to control and solvethe neighborhood disputes through analyzing the relevant data, with the hope to contributebuilding a harmonious society. All of the data comes from the A County People’s Court ofGuizhou Province. Since this is concerning the parties’privacy, some data has been adapted.The thesis is divided into5parts, totally about17,000words.The first part. The current situation of the neighborhood dispute-type criminal offence. Inrecent years, our country is in an important stage of social transformation; with the nationalsupport on both economic and policy, Guizhou province is confronting with both opportunityand challenge, all kinds of contradictions and disputes, especially the criminal disputes arisingfrom neighborhood are increasing, which have influenced the harmonious society progressseriously. In this thesis, the investigation of criminal cases in Guizhou province A Countyneighborhood disputes and the analysis of the present situation of the neighborhood disputescriminal crime have reflected the defects of criminal law for the criminal neighborhooddisputes.The second part: the classification of criminal neighborhood disputes. In recent years, thecriminal cases of neighborhood disputes increase gradually;(this part) briefly expounds theexistence phenomenon of criminal neighborhood disputes in A county through the statistics ofthe types of neighborhood disputes criminal cases ofAcounty since2008.The third part; the characteristics and causes of neighborhood dispute criminal offence.This part makes a reliable foundation for solving the neighborhood dispute criminal offence by a statistical analysis for the characteristics and causes of the neighborhood dispute incriminal cases inAcounty since2008.The fourth part, the law application of neighborhood disputes criminal crime.based on allthe neighborhood disputes-type criminal cases, analyzing under what circumstances by thecriminal law, and what circumstances by the civil law, and is there any mitigatingcircumstances when by criminal law,and how to implement it; in this case to have a betterunderstanding for the party’s appeal and make a proper law aplication to maintain socialharmony and stability.The fifth part; The prevention of neighborhood dispute-type criminal offence. From thefirst four parts of this thesis, the prevention measure for neighborhood dispute criminaloffences can be concluded to maintain the socialstable and order.
