Research On Causation And Countermeasure Of Bribery Crime In Qianxi Area

With the rapid development of China’s economy and society, the government hasincreased the investment for the basic industries and infrastructure. Meanwhile, briberycrimes occurred in the construction field are also increasing. Therefore, making theconstruction field as a starting point, it has an important and urgent practical significance tostudy the bribery crime phenomenon in this area and build an effective measure system ofpreventing crimes, through the analysis of its causes and development trends.Based on many years’work experience of engaging in corruption and briberyinvestigation in Qianxi region and combined with the knowledge learned during three years’graduate study, the author in this paper has an in-depth analysis of the detailed basic data andthe real-world cases so as to find out the causes of the high bribery crime occurring in Qianxiconstruction field and put forward advice on how to build an effective measure system toprevent such crimes on the basis of the positive experiences of other countries and regions.It is divided into four sections as follows:In the first part, several basic concepts related to the study are clarified first, and then abrief overview of the basic situation of the bribery crime in construction field is carried out,finally the research status in this field is commented.In the second part, through numerous tables and large amounts of data, the real basicsituation of bribery crime in Qianxi construction field in recent years is comprehensivelyreflected, which is specifically divided into: corruption, bribery crime rate, and the crimesubjects’ educational level and age when conducting crimes, the serving time and the positionof the crime subjects when conducting crimes, illicit money involved and where they aregoing, criminal justice on accepting bribery crime and offering bribery crime.In the third part, on the basis of in-depth research, it is summarized the corruption andbribery crimes in Qianxi construction field have the trends that the bribery crime incident rateis higher, the main crime subjects are younger and have higher education, illicit moneyinvolved is gradually increasing, and the crime subjects’ power is larger and serving time islonger. And the trend of light punishment judgment on bribery crimes is highlighted as wellas the reasons of the frequent crime occuring is resrearched and identified.In the fourth part, to effectively prevent bribery crime in construction field should start with two levels. At the normative level, the systems of the standardization of sentencingprovisions, design of fine punishment and “tainted witness” exemption system should beimproved. At the institutional level, efficient information disclosure mechanism should bebuilt; market access standards should be strengthened, the construction trade market should bestandard; and the cadre rotation and exchange system of key areas and positions should bestrengthened.
