Research On The Investigation Countermeasures Of Commercial Bribery Crime In The Engineering Construction Field

In recent years,the field of engineering construction has gradually become the hardest hit area of commercial bribery crimes,which was cracked down as the main area of commercial bribery crimes by the police.The engineering construction project features five characteristics,including capital investment intensiveness,complex participation components,diverse management links and wide coverage.It becomes the breeding ground for commercial bribery crimes.This kind of cases covers almost the whole process of the engineering construction.Criminal process is often concealed with prominent characteristics of the long incubation period and the diversification of criminal subjects which lead difficulties for the police in detecting such cases.The police are often confronted with difficulties in finding cases and obtaining evidence,and making breakthrough in trials.As a high-risk area of commercial bribery crimes,the engineering construction field has seriously impact on the normal operation of the economic order of the construction industry,which results in national taxes loss.The engineering construction crimes often cause a large number of security risks due to quality problems.In view of the high incidence rate of commercial bribery crimes in the field of engineering construction and social harm,it is of great significance to strengthen the analysis and research on the investigation of such cases to improve the ability of the police to investigate such criminal cases.From the perspective of the police in investigating commercial bribery crime cases in the field of engineering construction,this paper based on the analysis of relevant cases investigated and combined with existing theoretical research together with practice experience.This paper is divided into five parts: The first part is an overview of commercial bribery crimes in the field of engineering construction,starting with defining commercial bribery crimes and clarifying the concept of commercial bribery crimes in the field of engineering construction.The second part mainly introduces the characteristics of commercial bribery crime in the field of engineering construction.The third part focuses on the main issues in the commercial construction bribery crimes in the field of engineering construction,including the project establishment links,bidding,approval,exploration and design,engineering change as well as fund management.The fourth part analyzes the causes of the difficulties encountered by the police in investigations of such cases,especially difficulties in detecting,obtaining evidence,and difficulties in interrogations.The fifth part elaborates the investigation methods of commercial bribery crime cases in the field of engineering construction,including the acquisition and analysis of case clues,the identification of criminal facts,improvement of the evidence chains,the strengthening of interrogation work and the reinforcement of internal and external cooperation in the investigation processes.
