In recent years in our country, a serial of scientific principles and regulations forrestricting unlawful insurance act have been made and legislative resources have been put intoimprovement and rectification of insurance marketing. At the same time, insurance lawenforcement has been greatly strengthened.However, the effectiveness of punishment for unlawful insurance act is far fromsatisfactory. Let alone the effective constrain of serious violation of insurance regulations.Many factors account for the phenomena. The insurance marketing itself as well as thegeneral economic situation of our country, the influence of culture and politics as well as theweakness of law, the legal system as well as legal culture, all are involved in the account.In previous relevant researches home and abroad, many scholars have analyzed theeffectiveness of punishment for violation of present insurance regulations in their theoriesfrom cognitive perspective, focusing on the analysis of relation between unlawful insuranceact and its punishment.Nevertheless, most of the previous research results have been obtained mainlyqualitatively and in a deductive way. So its premise, that is, the judgment of the effectivenessof punishing violation of insurance regulations, is deductively obtained and needs morescientific proofs. Since this study of the premise is very basic for further study of the effectivepunishment of violation of insurance regulations, it is of necessity to clarify and provide morescientific evidence for effective improvement and rectification.Thus, this study will be conducted both qualitatively and quantitatively. The data of5339written decisions will be analyzed by SPSS and their functions will be discussed from threeaspects: a. reaction speed of written decisions to violation; b. properness for punishmentdegree of violation; c. deterrent power for unlawful act. After the discussion, suggestions forimprovement will be provided. Layout of this paper:The first part is going to talk about the criteria for evaluating effectiveness of violationpunishment. First, concept of effectiveness of violation punishment will be introduced so as topave the way for putting forward the goal of this study.The second part is about the population. This part includes the introduction of populationsource, selection method and analysis of the selected population.The third part is mainly about the promptness of the punishments, including the basis ofthe analysis and the reason of the ineffectiveness.The fourth part is talking about the properness for punishment degree of violation. In thispart, regression analysis method will be used for the analysis of violation and punishmentdegree. In addition, a data way is used to measure the degree. At last, an ineffectiveness of theproperness for punishment degree will be concluded.The last part analyzes the preventive punishments. The rate of the recidivism will beused to test the effectiveness of preventive punishments. Different subjects, reasons, and basisof recidivism will be tested to draw a conclusion of ineffectiveness of preventivepunishments.
