The right to education is a fundamental right for citizens, it is described as a hotacademic research. Recent studies on the nature and the relief of right to education right fromthe initial research in macro perspective, to the current research on the right of the childrenleft behind, the vulnerable groups and other criminals from such as the micro perspective,however, the study on the right to education of citizens is handful in national educationexamination. For our existing education system, the link between national educationexamination and citizens enjoy the right to education is closely, Research and analyse theright of citizens to education in the national education examination, on the one hand, this canprovide a new perspective to study and I can try my best to contribute to the theoretical studyof the right to education; on the other hand we can also make in-depth understand of citizensthe right to education in the national education examination, and thus better protect citizens’right to education.For the structure of this paper, the text is divided into five parts in total. The first partstarting from the basic theory, in-depth analysis prominent feature of citizens’ right toeducation in the national education examination, as a theoretical groundwork for laterdiscussion; The second part try to prove the necessity of protecting citizens’ right to educationfrom citizens of their own development, social order and stability, national educationexamination system running, to seek a theoretical basis for the study of this article; The thirdpart regarded typical example appeared in college entrance exams and graduate entranceexamination as an entry point to analysis existing difficulties guaranteeing citizens’ right toeducation in proposition stage, surveying stage and marking phase of national educationexamination, to provide realistic basis for the protection of citizens of the right to education inthe national education exams; The fourth part start analysing the causes of plight faced byguaranteeing citizens’ right to education in the national education examination from theperspective of normative level, the examination bodies setting, the operation of testing powersand citizens’ rights awareness, and thus be able to understand the crux of the dilemma; Afterthat, I try to put forward achieve path of safeguarding citizens’ right to education in thenational education examination.
