House-site in the countryside is an important part of rural land, the land is one of thefarmer’s most basic property rights,and the problems of rural housing land use right to enterthe market trading mattered the vital interests of the farmers. In the city mass state-ownedland were transferred and have formed a more perfect market,under the premise the farmersneed to let go of the object and scope of the land circulation, through the land to the collectiveeconomic organizations outside the body of the criculation, realised the implementation of theproperty rights of housing land use right. In January2014, the state council issued <<severalopinions about comprehensively deepen rural reform to accelerate agriculturalmodernization>>, stressing the need to "carefully and steadily push forward the rural landcirculation, improve the urban and rural construction land linked to the pilotwork". At present,many areas of our country is the pilot rural housing land market circulation transactions, butin the premise condition, circulation,circulation scope rules are not the same, which have notformed a unified transfer mechanism and is still in the exploratory stage. In this paper, I willstart from the basic theory of rural housing land circulation, combined with the presentsituation of rural housing land use right circulation.The right to use the pilot area of rurarland marketcirculation patterns are analyzed, and finally construct the countryside homesteadright of use to enter the land market system of concrete transfer.This article mainly through four parts besides the introduction and the conclusionThe first part mainly discusses the basic theories of the land use rightcirculation,including the concept, nature and the land of housing land use right circulation ofthe connotation, theoretical controversy. And then analyzed the necessity and feasibility ofmarketization of housing land use right transfer.The second part analyzed the circulation system of the right to use the rural land in chinafrom the angle of legislation, points out the law strictly limits the countryside homestead rightof use circulation problems.The third part is the analysis of the different testing in China for the exploration of ruralland into market circulation, through the testing of rural housing land use right to enter themarket by use of different methods, the analysis of the effect, as discussed below themarketization of housing land use right transfer practice foundation.The fourth part, analysis based on the above,the rural housing land use right to enter land market circulation system was conceived, auxiliary measures including the rural housing landlegislation, conditions, scope, mode and the land use right to enter the market circulationIn a word, through the analysis of this article, we have plenty of reasons to prove that thehousing land use right transfer market more in line meet the needs of the development ofcontemporary China. Through continuous practice and exploration, establishing andimproving the land use right to enter into the land market circulation system, can realize theproperty rights and interests of farmers for the land,and promote the optimal allocation of landresources.
