| People’s Procuratorate is a national legal supervision organ. Starting fromprocuratorial power theory and juridical status of the procuratorial organ, the procuratorialorgan has the right to carry out the supervision on the law enforcement of theadministrative bodies and maintain the uniform implementation of the law. However, it isinappropriate to the position of the procuratorial organ as a national legal supervisionorgan. In recent years, some local procuratorial organs have launched beneficialexploration and attempts on the aspect of carrying out and strengthening the administrativeenforcement and prosecutorial supervision. However, they also face many difficulties andchallenges, and hope to achieve new breakthrough in the theory and practice.This paper starts from the reality significance of the administrative enforcement andprosecutorial supervision work, and then discusses the legal attribute and value of theprocuratorial right of the administrative enforcement. To perform prosecutorial supervisiontowards the administrative enforcement activity not only conforms to the constitutionstatus of the procuratorial organ, but also is regarded as the best embodiment of the legalsupervision right of the procuratorial organ in the domain of administrative enforcement.According to the specific practice, this paper carries out deep discussion on the currentstatus and existing problem s of the procuratorial organ to perform the administrativeenforcement and supervision during the current practice. Meanwhile, by virtue of thereality, it puts forward suggestions related to strengthening the administrative enforcementand prosecutorial supervision, so as to build sound administrative enforcement andprocuratorial system, and thus effectively solve the related difficulties. |
