From in the first half of this year to investigate and punish case,embezzlement and bribery crimes appear some new laws and new characteristicswith the progress of science and technology and era, the subject of duty crime meansway more and more intelligent, high-tech, the procuratorial organs investigationcrimes facing unprecedented challenge and severe form, in this context by means oftechnical investigation to break the dilemma is the inevitable choice.The regulation of our country for the technical investigation measures tooscattered, led to the technical investigation measures shall be applicable to thereasonable and lawful ambiguity exists. In2013began to implement the newcriminal procedure law has been clear about the procuratorial organ has theindictment. This article tries to combine the judicial practice and criminal law theory,in practice the urgent demand of the development direction of guiding theory, thetechnical method in the legal aspects and discusses and analyzes the problems in thejudicial practice, for the procuratorial organ in conduction duty crime cases througheffective technical investigation methods to carry out the theoretical basis andreferences for preliminary investigation evidence collection, etc.
