Comparative Study On The Government Procurement Law Legal System

With the growth of the scale of China’s Government Procurement and the development of the socialist market economy year by year, our country have embarked on the government procurement since1995, China’s Government Procurement Law entry into force on January1,2003, on July9,2010, our country submitted the application to the WTO committee again to suggested to join the government procurement agreement. At present the research the study of our country government purchasing research on theory can be deepened and developed, we can perfect government procurement law system and the related mechanism, provide system security for the government to the benign development of government procurement and to join the WTO government procurement market.In this paper, by the comparison and analysis of the legal system of China’s government procurement with GPA, the EU and the U.S. government procurement legal system, proposed suggestions for our reform and improvement of the legal system of the government procurement.The train of thought of this article is basically analyzing the general problems of the government procurement at first, In the clear and deepening some theoretical problems later, analyze the European Union and the United States government procurement law system, fully absorb the theory and the practice, then puts forward the significance of reference at present for China, then with a government purchasing theory and practice, conclude the existing problems and the insufficiency of our country government procurement law system.In this paper, the first part, expound the government procurement law regulation concretely from theory. The second part, summarized the government procurement agreements of WTO. The third part, the fourth part, In-depth introduce and analysis the government procurement system of our country and comment the system of the United States government procurement, then summary mode for our country for reference. The fourth part, analysis the advantages and disadvantages of China’s accession to the WTO government procurement agreement, make corresponding suggestions after combined with the government purchasing situation and referred model all over the world.
