From1840up to now,the thought of Chinese is no longer just dominated by Confucianism,Taoism and Buddhism as a supplement of the situation of the three pillars of.Western gunboats in opening Chinese’s doors, at the same time also makes the Chinese came into the inner world of the western Chinese culture,modern western constitutionalism and Marxism,and so on all kinds of theory.From then on,China began to social unrest,the nation apart ideological chaos gone with phase,until the founding of the People’s Republic of China in1949,the country to the unity of the real.Especially in the reform and open policy for30years, the country’s economic development,cultural prosperity,the people have the time conditions of real began to reflect on history for more than one hundred years of thought Back in one hundred the ups and downs, in the face of the main problems facing in domestic and international,we already can’t avoid,is to go back to the traditional Chinese way,or follow the west,or find a new way to,this is already the time to make their own decisions.Therefore, this article obtains from the Chinese and western natural law analysis, suggest that China and the west each has a set of suitable to their social and cultural history of the concept of natural law. Then to the modern history of China in to the\"Confucianism\" carding process of gain and loss, then draws the lessons from the modern China to Confucianism. In the interpretation of Confucian legal thought in the history of managing state affairs by ethics in China on the basis of the positive role, specifically discusses the essence of Confucian legal thought in China’s internal affairs diplomatic and benefits to the guarantee of human rights, and then to China’s current positive impact of the construction of the rule of law.
