Research About Dignity Of Human Personality In Domestic Constitution

The definition of dignity of human personality in domestic constitution refers to the same meaning of humanity dignity and personal dignity in academic field, according to the dimension of constitutional jurisprudence. Research conducted by the academicians on human personality dignity formed various perspectives which holds varied distinctions such as personality right, basic independent right, dignity right, core values in rules of law, personal freedom right and personal right. The human personality dignity focuses its principle part on human, including two parts of personality right and dignity right. Dignity right holds an important place in the constitution. As a fundamental right, dignity of human personality also shows the basic value of constitution. This right is also featured in several aspects, such as the subjectivity, equality, absoluteness, highness, apriority and openness. Human personality dignity can hold a series of function of defense, demand and systematical protection. The limitation for basic rights doesn’t involve the citizen’s human personality dignity. This kind of right is the basic standard in the constitutional review, a supplementary right, a foundation of constitutional explanation. The current situation of the protection of human personality dignity is the blurring lines in laws, deficiency in administration and absence in judicature. The shortage in domestic human personality protection mostly appear as the ignorance in the basic right system, little knowledge of scholars, blurring protection laws, unsettled rules in social life and weak review system of constitutionality. In need of a complete protection of human personality dignity, the country should lay the basic rights as the core part in the constitutional basic right system and set up an effective constitutional litigation system.
