Currently, the climate summit negotiations stalled, while environmental problems are getting worse, the rhythm of negotiations and negotiations between Member States hardly achieved remarkable speed to keep up with the deterioration of the environment. China ushered in the worst ever,"haze" Weather in2013. Existing climate summit has seriously hindered the improvement of the international climate cause further development, lazy members, shirk attitude again and again to make the negotiation of environmental protection into a deadlock phase, the United States announced its withdrawal from the "Kyoto Protocol" and the developing countries such as China,as the biggest greenhouse-gas emitters, still only bear the "differentiated responsibilities", there is no obligation for China to undertake a mandatory emission reduction which is an important reason for the climate summit in a difficult situation to entered into a substantive phase of negotiations.The author studies the topic, mainly wants to advocate in the climate summit talks, a kind of value which is that the maintenance of the public interest of the international community has the priority, especially in the public domain in international affairs, in particular, the problem of environmental pollution is always beyond the regional. And the author thinks that the realization of this idea is to have a certain of the possibility; Secondly, as early as in2011, Xie Zhenhua, the Chinese delegation put forward "Chinese can accept a coverage of all the countries, legally binding agreement, but must be under five conditions." In the face of developed countries accused, severe climate situation, as the biggest developing country, we have begun to do something in the breakthrough of the deadlock existing in the climate summit. The cause of environmental protection from January1st this year the implementation of new environmental protection law and this year NPC and CPPCC on the attitude of the government, it can be seen that Chinese have consciously practiced international obligations under the international climate change regime. Prior to the arrival in2020, the author thinks that Chinese may try to use the United States and Japan put forward the "bottom-up" vernment attitude analysis extends to establish international position. The fourth part mainly is a vision of future climate change in the system Chinese standpoint, the author through the Chinese currently own orientation, and the transformation of the government’s attitude on environmental issues, to explore the approach to emission reduction, proposed a carbon emission reduction planning floating interval and a specific timetable. At the same time to strengthen the cooperation with other member states in addressing climate change issues and exchange, the further development of mutually beneficial and win-win pattern take to jointly promote the development of the international environmental protection negotiation.China as a responsible big country, we should consciously practice, international obligations, to do so not only is conducive to the maintenance of international public environment, but also conducive to the Chinese combined with other developing countries together, hold a more bargaining chips in the climate summit talks, a building is conducive to their own interests the negotiated order, attract capital and technology more on support from the developed countries.This paper is divided into four parts, the first part mainly introduces the development status of the existing international climate change regime, outlined the climate summit important achievements, such as the "United Nations Framework Convention on climate","Kyoto Protocol", and also briefly introduced the recent status of the climate summit talks. The second part mainly is the reflection on the existing status of international climate negotiation and system, this part is divided into2chapters, the first chapter is mainly aimed at the current situation, the existing situation of climate change negotiations, some thoughts on the legal system in the development of deadlock. It is clear, the Sino US confrontation is the main cause of the deadlock situation, which also involves international law inherent "soft" side, and also summarizes the Durban platform multi-interests, gradually leads to "thinking about the importance of public interest" the international community to and maintenance of "sustainable development" mode. The second chapter is the main part of legal thinking of the environmental legal system of international environmental law, the first feature from their hands, then seize the environment and development, environment and sovereignty, analysis and interpretation of the relationship between two pairs of contradictions, it was concluded that the environment and the sovereign can have unified side, the sovereign may be environmental improvement can also be a killer, it depends on the political will to change the sovereign; and environment and development can also be complementary to each other, we can seek for a "green economy","ecological economy" mode and implementing environmental law established the principles of "sustainable development". The third part is mainly the analysis of Chinese environmental position held since80, and on the current environmental issues related to the attitude of central government and the relevant laws and regulations of the interpretation, the main purpose is to by the domestic central gothree aspects of emission reduction responsibility assignment way draw a conclusion: the arrival in2020, Chinese can try to take the "bottom-up" to undertake emission reduction obligations, is the formation of a "soft law" of alternative solutions approach a brave attempt, but also lay the foundation for2020after the "new Paris agreement" was reached.
