Research On Law Of Land Use Right Transfer In Vietnamese Real Estate

Vietnam is an agricultural country and agriculture plays a very important role in the economic structure with large amount of proportion. Agricultural manufacture has accounted for about30percent of Vietnam’s GDP. With the implementation of Vietnam’s economic reform in1986and the rapid development of social economic, modernization and industrialization, Vietnam has made lots of significant changes in economic structure. Therefore, other industries and fields also developed quickly, such as, construction, import and export, services, health, education, especially real estate. In recent years, Vietnam’s urbanization is accelerating, and many villages have become cities. The need of housing is increasing, and as the result, the real estate markets also become extremely stronger. There are a lot of real estate exchange centers appeared recently, and real estate transactions or trading activities happen frequently. So, nowadays people in Vietnam tend to pay more attention to the regulations and relevant laws on land use right transfer when doing real estate transactions. Regulations and laws on land use right transfer obviously play a significant role in buying house activities or in real estate transactions. However, there are still many deficiencies exist in regulations and law systems on land use right in Vietnam. That is why, as a Vietnamese students studying law, I want to understand and research the Vietnamese real estate laws, especially regulations and laws on transfer of land use rights. In this study, firstly I start with the theoretical review of laws on real estate and land use rights transfer in Vietnam. After that, I decide to research the main content of Vietnamese laws on the transfer of land use rights, thus pointing out problems and present my own suggestions to improve the Vietnamese laws of land use right transfer.
