Try To Consummate Our Company Division System As A Case In South Korea

Company division as an important system in company law, it is important way to the company for the pursue management specialization, efficiency, the company’s financing and diversification of risk, therefore, company division is the one of the important business strategy for the modern company to carry out the assets reorganization, adjust the organization structure, to reduce the investment risk, improve corporate profitability.As it is the great of significance in the restructuring of the company, South Korea to pass legislation to establish the company division. Our country also will to adapt the same action and explicitly stipulated the company division system in the company law. Although our country’s "company law" provisions of the company division system, but it is too general provisions about limited to article 176,article 177,it is limited to article 176, article 177 of too general, so the law application is too great confusion. The purpose of this paper is to through the regulation of system of Korean company division, with comparison method to explore the present situation of our company division system and the existing problems, and then points out the direction of the future that our company division system’s reformation.
