The commercial housing presale system has been officially used in China since1994. It has made a great contribution for the prosperity and development of the real estate industry of our country by reducing the burden for the house buyers and solving the operation fund problems for the developers, and rapidly become the major operation device of commercial housing. However, at present, the laws and regulations for the commercial housing presale system is not perfect enough and far lagged behind from the development. For example, commercial housing presale funds are not supervised well, and there are no unified national standard. For this, there rises the question that how to solve the problems rose from the imperfection of the commercial housing presale system. This paper tries to make a comparative analysis between the commercial housing presale systems in China and S. Korea, aims at solving the existing problems in the practice of the commercial housing presale system, and hoping to get an experience for reference to perfect the commercial housing presale system in our country.Chapter one is introduction. It aims at pointing out the theme of this thesis, including the purpose and significance of this thesis, the previous research, research scopes, and research methods. Chapter two summarizes the commercial housing presale system. It includes the concept, characteristics, properties as well as the process of emergence and development of the system to a whole view on the system. Chapter three starts with the terms of access of the commercial housing presale system in China, analyzed the presale contract filing system, advance registration system, fund supervision system of the commercial housing presale system, to explain the system in China in the holistic view. Chapter four is about the commercial housing presale systems in S. Korea. In this chapter, the author analyses the terms of access of Korean commercial housing presale system, commercial housing registration system, false registration system, guarantee system, and housing presale subscription system, and made a foundation for the comparative study between the commercial housing presale systems in China and S. Korea. In Chapter five, on the base of the comprehensive analysis on the commercial housing presale systems in the two countries, the author made a comparative analysis on the two systems and put forwards some suggestions for the system in China. Chapter six is the conclusion. The author summarizes and concludes the whole thesis.
