In China,the collective farm is a new agricultural organizational form,as one emerging land circulation way,the land contract and management right shares have the important meaning regarding our country rural development.The farmland stock cooperation system was a land utilization way which took the farmland as the capital and invested into stock type cooperative farming economical organization and executed cooperative production and management,it was the farmland utility right transaction way which was established on the basic of family contract-management.It was agricultural cooperation operation form which fuller used land resources.Due to the theory of basic research is weak and the lagging of legal norms,makes a series of problems in the development process of collective farms can’t be settled in a timely manner,the serious influence the development of collective farms.This article will collective farms in the construction of modern agriculture marketization environment,the first since the founding of the rural economy development in our country are reviewed,the background of collective farms,elaborates the connotation and function of innovation.In the United States,France,Japan and our country Taiwan area as an example,the legal system of the above countries and regions,farms,they are on the farm continuously explore and perfect the legal system in the practice of accumulated precious experience is worth learning and using for reference.Through the development of collective farm practices and legislation present situation analysis,find out its main problems,main show is the legal status of collective farms are not clear,unclear property right structure and operational mechanism in management,imperfect social security system and risk prevention mechanism,etc.Finally,in view of the problems appeared in the process of development of collective farms as well as the related legal blank,this paper put forward the countermeasures of perfecting our country’s collective farm legal protection:suggest formulating laws and regulations about collective farms,clarify the legal status of collective farms,clear property right structure of collective farm,standardized collective farm management mechanism,improve the collective farm risk prevention mechanism and safeguard system,etc.,for our country the rule of law in the healthy development of collective farms,to create a good environment.
