Study On The Effectiveness Of Trade Barrier Investigation System In China

In the post-crisis era, under the new trade protectionism theory, protectionism risesand falls among nations. There is a trend of diversification and increasing concealment.In2013, China replaced the United States as the world’s largest merchandise tradingnation. At the same time, China has experienced18consecutive years to become thenation which experienced the largest number of national trade friction cases. And at thisstage the trade friction is a strategic trade friction, especially the new energy industrieswhich will be the focus areas for future trade friction. In2010, United States investigateChina’s new energy policy with Section301.Out of contending for the peak of the thirdindustrial revolution, China and the US enter a period of high friction, and now tradewars between nations gradually evolved into the game of trade rules. So as rapidresponse mechanism for trade barriers, trade barrier investigation has importantsignificance for China.WTO is the product of multi-national compromise after several rounds ofnegotiations, a unity of trade protection and trade freedom. So under the WTO regime,trade barriers have their space of survival and development. In China, by growing as atrade powerful country, international trade friction will definitely show characteristicslike normalization and sophistication. Trade barrier investigation system, as an effectivesystem to provide basis with domestic law to deal with other country’s trade barriers forthe domestic industry and other organizations, but also enhances the ability of agovernment to maintain its foreign trade order and economic security. However, tradebarrier investigation system in China from the date of birth actually just twelve years,has been used in two cases during this period, and its effectiveness is obvious. Therefore,this paper studies the effectiveness of trade barrier investigation system on the basis ofthe theory to provide logics for the paper below; by a comprehensive introduction onthe American system of trade barrier investigation, in order to analyze American’sexperience; on that basis, this paper studies the problem of the effectiveness of oursystem by empirical analysis and providing relevant advice on how to improve theeffectiveness of China’s trade barrier investigation systemThe key of law lies in experience. If people only focus on the law not theeffectiveness of the operation of law, then the law is a dead letter. This paper focuses onthe "living law" to improve its effectiveness by studying its effectiveness and a series of related problem, so as to really play the preset function and proper value of trade barrierinvestigation system in China.Under the new situation, trade barrier investigation system for China’s tradeactivities is highly relevant and practical, but the scholars is still mainly focus on thecomparison on the system of China and foreign country and improvement on our system.Focusing on the effectiveness of system can not meet the needs of our foreign tradesituation. Therefore, This paper analyzes the effectiveness of "Section301" to find outthe problems of our System’s effectiveness. We should learn from the advancedexperience in order to improve the effectiveness of our system. China should by virtueof its strength in international trade and a huge domestic market, make use of tradebarrier investigation system effectively, eliminating all barriers encountered in China’sforeign trade and actively exploring the international market, to protect our economicsecurity.
