Research On Section301of The U.S. Trade Act And Its Practices In China

This paper is mainly about the section301of U.S. Trade Act and how it applied to our country. Aswe all know, this section is widely used by the U.S. government to protect their own trade. This paperdiscusses the history and the substance of the section301. And it also discusses the famous WTO caseabout this law and some investigations based on this law and these cases are related to China. Thepurpose of this paper is to find a way which combines the advantages of all the methods of traderemedies to reply the future investigations based on section301of the U.S. Trade Law.Part Ⅰ: This part mainly introduced the section301of U.S. Trade Act. It includes the back groundof section301, the mainly content of the context, and the development of this section and the procedureof this section. In the end of this part, there is a brief comment of the section301.Part Ⅱ:This part analyzes those301investigations based on section301before the World TradeOrganization is founded. And those cases were all related to China. To discuss whether this section isconsistent with the WTO rules, this part introduced the case "UNITED STATES–SECTIONS301-310OF THE TRADE ACT OF1974", and made a comment on the report of the panel.Part Ⅲ: This final part is mainly about those301investigations which based on301section afterChina joined in the WTO. And there was only one301investigation till now, the investigation is aboutour clean energy sources. In the end of this paper, concluded some measures to reply to the future301investigations.
