Research On The Legal System Of Charities

Charity is known as the third-time social distribution besides the tax allocation and market allocation, it effectively promotes social equity, and has an important role in the construction of a harmonious society, and moreover it is an indispensable part of the social security system in our country. But owing to the relatively late development of modern philanthropy in our country, the policies and regulations system is not sound, charitable activities are not standard. These cause big problems in the running of charity institutions, especially the supervision mode. In recent years, the constantly reported charity scandals, corruption or other events further pushed the philanthropy to the forefront of the public criticism. Therefore, China needs to actively perfect the legal system of charity supervision.It introduced the background of charity organizations and the conceptual analysis of charity organization regulation in our country, such as charity organizations, supervision of charity regulation and its importance and necessity. It also gives a full introduction of the legal system of western charity regulation in order to learn their advanced experiences. The analysis of the present problems arising from charity organization supervision in our country, mainly from the four perspectives, the legal system construction of charity, the organization supervision of charity, the governmental supervision and the social supervision. Four serious problems are discovered during the analysis, that is, the legal system is not sound, the internal supervision of charity is insufficient, the governmental supervision is dislocated, and the diversity of social supervision is not truly formed. On the basis of fully respect for China’s national conditions and practice, by taking the advanced western charity regulations the building of the open supervision system of countermeasures which supervised by four hands, the legal protection, industry self-discipline,governmental supervision and social supervision.
