Reconstruction Of Social Compensation Fee Collection System

As a developing country, the population issue has been an important factor in restricting and affecting the economic and social development of our country. In order to control the population and improve the quality of the population, our country always adheres to carry out and implement the family planning policy. Besides, the social compensation fee collection system has been considered as a safeguard for the effective implementation of the family planning policy. The social compensation fee comes from the "bounce back fine"and the"unplanned birth fee", which highlights a shift in the concept of the rule of law and the protection and respect for human rights. Since the implementation of the social compensation fee collection system over the years, it has made remarkable achievements, which plays a key role in the development of China’s population implementation and family planning programs. With the development of the social economy and the rule of law, due to the system its own design flaws, the problems in the collection process and the need for social compensation fee collection system of the family planning policy adjustment during operation highlights a series of questions, to some extent, restricted to effectively play the role of the system, can not fully comply with the legislative mind.In this paper, according to the basic principles of the administrative law, first of all, I will discuss the evolution of social compensation fee collection system in theoretical discourse, and then, using three typical social maintenance events to point out the legal issues involved and behind the events and triggered by thinking. Moreover, to analyses the issues arising from the design of the system itself, as well as flaws in the process of collection enforcement aspects of the social compensation fee collection system in-depth. Finally, from the existing problems of social compensation fee collection system, combined with China’s family planning policy and the main reason for the current problems, I want to seek to resolve the issue of social compensation fee collection strategies and initiatives, so that the system is able to play its role effectively and in accordance with its legislation mind, at the same time, more in line with the needs of socialist construction of the rule of law, and achieve the ultimate goal of building a harmonious socialist society.
