The Location Of Rural Land Expropriation Compensation Dispute Research

Land is the most basic elements of agricultural production., closely related to the farmer’s production and life. For farmers, the land is not only production, but also bear the social security function. So when the farmers’ land expropriation in the public interest, expropriation compensation allocation will naturally become the focus of concern to landless peasants. But at this stage, "Land Management Law", "Property Law" and other laws, and can not properly resolve the issue of land acquisition compensation allocations, resulting in the process of land acquisition compensation allocation disputes.In this paper, Yanbian Prefecture, for example, first of all, to study the concepts of land acquisition compensation and the current status of legislation.Secondly, the study analyzed the dispute in the state’s rural land expropriation compensation, discovery led to the continuous distribution of compensation to correct the cause to be "married women", "rural", "empty hanging households", "foreign citizenship" these problem.In this paper, cited a typical case of the above problems, the expedition to analyze the problems in the compensation process. Meanwhile, the typical case of Yanbian and the provinces within the same type of court case were compared.Finally, policy and case studies, and found that the main distribution of land compensation disputes because the distribution of land compensation eligibility confusion, land acquisition and compensation narrow object, compensation standard is low, the lack of compensation for expropriation of due process of law, and this raised a few questions for the corresponding solutions.
