Research On The Crime Of Trafficking In Persons

The crime of trafficking in persons taking people as a commodity to sell. It has a serious crime subjective and a complex crime pattern. Infringing upon the personality and dignity of another person has a great bad influence on the society. To learn from criminal law in our country and other countries, we found that there are many problems in our current criminal law of abducting and trafficking in women and children. For example, the object of the crime is too narrow to solve the problem of the adult male abduction. Subjective aspect can not be covered by the generalization of this kind of crime of all crime purpose and characteristics. It also has some problem such as aggravating circumstances and improper sentencing. These problems make the difficult in the logic of law and cannot be directly used for solving some difficult cases, is not conducive to the effective crack down on human trafficking crimes. I think that we should cancel the crime of abducting and trafficking in women and children, we need rebuild such crimes from the perspective of the crime of human trafficking. In this paper I will introduce the views of domestic scholars on human trafficking crime viewpoint, Put forward my views on the basis of the international conventions, study crime history and its features. I’m going to analysis Asian criminal law, discuss the current situation of the crime legislation in China. Finally, I’ll reset the crime of human trafficking elements and criminal penalty and put forward some suggestions on the revision of related offenses.
