A Study On The Crime Of Trafficking In Human Beings In Modern Shanghai

Trafficking in human beings is a long-standing social problem in the history of China.Up to now,the crime of trafficking in human beings is still in the stage of high incidence and multiple incidence.How to deal with this kind of crime is also one of the hot topics in modern society.From the late Qing Dynasty to the Republic of China,the relevant legislation of the crime of trafficking in human beings developed in twists and turns.In this period,the crime of trafficking in human beings in Shanghai was particularly rampant.The large number of cases,as well as the special political and social environment in Shanghai,make Shanghai not only accumulate a lot of experience,but also gradually form a special model of criminal governance.Based on the historical data and from the perspective of legal history,this paper first reviews the relevant laws of the crime of trafficking in human beings in modern China,and makes an analysis of them.Secondly,this paper selects the cases of the crime of trafficking in human beings in Shanghai during the period of the Republic of China,and studies the regional crime in a certain period of time.Finally,this paper combines the above two aspects to analyze the application of law and the governance of the crime of trafficking in human beings in Shanghai,trying to to extract the regular success or failure experience and lessons for the current reference on the basis of restoring historical facts.This paper is divided into five parts,the introduction part and four chapters.The introduction first puts forward the main problems of this study,and expounds the significance and research value of the topic,then sorts out the relevant research results at this stage,and opens up new research directions.In the first chapter,the author combs and analyzes the legal provisions of the crime of trafficking in human beings in modern times.In addition to the laws formulated by the central government,the author also selects some laws formulated by local governments for analysis,pointing out the problems in legislation and application of laws.In the second chapter,the author analyzes the crime of human trafficking in Shanghai during the period of the Republic of China.Through the combination of quantitative data analysis and qualitative research,this paper expounds the crime of trafficking in human beings in Shanghai of the Republic of China from the macro and micro perspectives,and analyzes the driving factors of crime.In the third chapter,the author combines the special legal environment of Shanghai in the Republic of China to make a more in-depth introduction and analysis of the investigation and trial of the case.At the same time,the author expounds the new criminal governance model of Shanghai in the Republic of China,which is to make up for the lack of official functions.Combining the above two,the author makes a more comprehensive analysis of the judicial practice of the crime of trafficking in human beings in Shanghai during the period of the Republic of China.In the fourth chapter,based on the previous article,the author thinks about the crime of trafficking in human beings in Shanghai during the period of the Republic of China.First of all,the author summarizes the problems in judicial practice and analyzes the causes behind them.Secondly,from the experience and lessons of failure and success,we can learn from the past and the present.
