The rule of law in the construction of a socialist country ruled by law, realization of the background, in 2015 the national provinces, city, autonomous region civil servants test and start, since 1989 began the implementation of the national examination system, conveying a lot of talent for the local government departments, enhance the vitality and the vigor of government organs, greatly improve the government’s working efficiency, but also establish a good image of the government to a certain extent. The civil service examination system is the implementation of another lies in the fact that the rights and interests of the candidates obtained the very good protection, especially the equal right to employment. In a fair, impartial, open enrollment system, all candidates are equal in the civil service examination, no privilege. The problems of legal protection of the rights of candidates of the core problems in the civil service examination system is the legal protection of the rights and interests, the need is not only a sound civil servants, reality, also need to safeguard the citizen constitution of political rights, labor rights, the right to education reality. However, during the 2010-2014 years, the civil servants admission had a series of infringing the interests of in the course of events, such as the "public test releases the topic", "Song min incident", "Xi’an candidates were hepatitis B" etc.. The occurrence of these events make the public justice on the recruiting system more and more questions, which also produced a bad influence on the credibility of the government, also infringes the lawful rights of the reference staff. Therefore, this paper through the Xi’an Li fen candidates in the examination process "hepatitis B" the event to the existing problem and reason analysis of the process of China’s civil servants aiming at these problems, some advice to perfect civil service examination system, to better protect the legitimate rights. The article consists of four parts of the following components:The first chapter is the introduction this paper mainly introduces the research purposes, research ideas and research methods.The second chapter is about the basic situation of the Xi’an candidates who were "hepatitis B" and the case of an angry activist and the final verdict of the court.The third chapter is on the case dispute focus of analysis, mainly analyses on Bureau of civil servants on the candidates for a medical examination whether to hepatitis B test items were detected, the focus of controversy for "xi Province national civil servant recruitment examination implementation details," the laws and regulations and whether the upper law conflict in the content, scope, hospital physical examination conclusion is valid and case law.The fourth chapter is for the Xi’an candidates Li Fen "hepatitis B" cases there are some legal issues for the legal analysis, to find which violates the relevant laws and regulations.The fifth chapter is mainly according to the fourth part of the existence of some problems of the application of the law, some violation of legal procedure to carry on the comprehensive analysis, from the legislation, legal supervision, social supervision, hepatitis B students right relief, increase supervision up some suggestions are put forward for their own, to avoid a repeat of disease discrimination.
