Research On The Legal Issues Of The Enforcement Of Urban Inspectors In China

City Management and Administration Execution Bureau was established to solve a wide range of urban management challenges during the development of urbanization.With the rapid development of social economy in our country, China’s urbanization process has been accelerated since the Reform and Opening up.A growing number of workers pouring into cities and the vendors living at the bottom of the cities have brought a great difficulties to the city’s managers. These factors affect our cities developed into a advanced,civilized and with rule of law.City Management and Administration Execution Bureau was born with the Promulgation of Law of the PRC on Administrative Penalty.It solved multiple law enforcement, repeated enforcement, law enforcement and other disturbing problems that existing for a long time. It maintained individuals’ legitimate interests and ensures an order operated city.But the city management is also facing new challenges. Relying on the Law of the PRC on Administrative Penalty and the current urban management and law enforcement mechanism cannot solve every kind of problems during the management of the city completely.Since the establishment of the law enforcement departments, the country has not promulgated a special law to provide more powerful support.There is no specific law to regulate urban management and law enforcement departments, and their own defects has not been remedied. All these factors lead to the contradiction between law enforcement departments and the administrative counterpart.In recent years, many phenomenon,such as the law enforcement officers "violence enforcement" and the counterpart "Violence against the law”,keep emerging on newspapers.“The Case of Wei Wenjie was beaten to death by a City Management and Administration Execution Bureau officer of Tianmen, Hubei”,“The case of Cui Yingjie, a vendor in Beijing,killed a city officer”,”the case of beating and trampling the counterpart’s head” etc.In all these events, whether the relative person beaten to death or the city officers were killed, they are all victims of the tragedy.Why the violence and bloodshed continued happen between the officer and counterparts?This phenomenon shows that the original contradiction has emerged and intensified between the officer and counterparts.In my personal idea, it is a pressing matter of the moment to alleviate the contradiction between them.We have to improve City Management and Administration Execution mechanism.We have to speed up the legislative work of special laws and regulations such as the "Law of the PRC on Administrative Penalty”. We ha ve to improve the methods of law enforcement departments and their law enforcement capacity. We have to solve the contradiction between the law enforcement departments and the counterparts fundamentally to promote the benign operation of the city.After analysis of the difficulties facing the law enforcement departments, this paper summed up the corresponging reasons and put forward some countermeasures.First of all, this paper has an overview of China’s urban management and law enforcement. In particular, it includes its origination, development process,the definition of the concept and theoretical basis.Secondly, this paper find the corresponding reasons after analyzing some specific case and relative books. This paper find the shortcomings of the law enforcement departments in law enforcement issues and the current system of law enforcement. Last, this paper propose some countermeasures to improve the existing law enforcement mechanism based on the analysis of the causes and related problems above.
