On The Legislative Modes Of Multimodal Transport In China

As an advanced form of transport organization, multimodal transport can greatly improve transport efficiency, reduce freight and cargo damage. With the development of container transportation and logistics, multimodal transport occupies a considerable and expanding scale in transportation market. However, China’s current legislation on multimodal transport lags behind the practice, the provisions is scattered and there is considerable blank in the system. Multimodal Transport lacks unified and coordinated system of legal norms or regulations. Based on the analysis of the current legislation and related academic views, also taking account of the investigated cases of foreign legislation, this thesis tries to find to a suitable legislative mode that meets the needs of multimodal transport development in China, also has no conflict to the current legislative tradition and technique.This thesis is divided into five parts:The first part explains the basic concepts of multimodal transport and legislative mode, limits the concept of legislative model discussed herein in a narrow sense, and then discusses the concept and the composition of legislative modes of multimodal transport. The second part introduces current legislation of multimodal transport in China, points out the deficiencies and discusses the causes. This part also reviews the academic views on the choice of legislative mode of multimodal transport. The third part introduces and compares foreign legislative mode of multimodal transport, tries to find out the reference to Chinese legislation. The fourth part analyzes the factors that influence the legislative mode, and discusses the choice of legislative mode in china and explains the feasibility. The last part is about the construction of the legislative mode, gives some advices on the legislative purpose, the nature of the law, the framework of the legislation and the external relations between multimodal transport law and other related regulations.
