On The Nature Of The Network Virtual Property And The Protection Of The Civil Law

In recent years, the network game industry is improving with the development of network industry. According to the states,in 2012,the number of the internet users reached 538000000.39.9% of the popularization of the network are gamer,1/3 of them are gamers.The actual sales revenue of Chinese game market is 60000000000 and the network Chines game market actual sales revenue is about 6000000000yuan.Online game industry has become a big filed of network operators.They will get huge profits.At the same time,the country has increased the support strength for the network game industry.The problems of the development of the network game industry conflicts the debates in academic circles.The author read the articles during last ten yeas.Most of them directly search ways of protection measures.In the courses of studying,protection measures has caused a very big argument among academic achievements.From these articles related to the protection of virtual property in the recent ten years, the author found that most of them directly talk about the virtual property protection measures,but the legal nature of the virtual property of the network has not been clearly defined.So we will talk about the features of the virtual property.This paper mainly divided into four chapters:In the first chapter, the author explain the definition of network virtual property. And then explain that the network virtual property should be separated into two aspects,the broad sense and narrow one. It will be the base of the debates.In the second chapter,the author analyze several important theories about the legal views of network.Including property right,claims and intellectual property rightAccording to these analyses,the author deny that the network virtual property is the object of real right,creditor’s right and intellectual property. So it is regarded as a special property right.In the third chapter,the author inspects the legal provision of the network virtual property of Taiwan, Hong Kong and South Korea. In the fourth chapter,we will study the protection of virtual property in our country.In the fourth chapter,the author list the weakness of protection of the network virtual property in our country. And then propose some suggestions for advice.
