Research On Judicial Practice Of The Introducing Bribe Crime

Though introducing bribe crime as a light punishment of corruption and bribery crime, but in the role of the system of corruption and bribery crimes it can not be ignored.With the increasing efforts to crack down on corruption, bribery and corruption in judicial determination of such cases is increasing, the number of introducing bribe crime cases is growing rapidly. The behavior of the introducing bribe crime in judicial determination, however, with the assisting behavior of bribery, the assisting behavior of acceptance bribes is difficult to distinguish, and the legal punishment of bribe crime and bribery of legal punishment and comparatively large defference, theoretical and practical circles caused disputes increasing.The theoretical and practical circles controversial mainly focus on the relationship of the behavior of introducing bribe crime and the assisting behavior of bribery.This paper introduces the definition of the behavior of the introducing bribe crime, combs the introducing bribe crime issues of the theoretical circle of criminal law, determines the scope of the introducing bribe crime combined with judicial practice, through the concrete case analysis, to further clarify the author’s point of view. The text is divided into four parts, the first part is the introduction of the behavior of the introducing bribe crime, bribery and acceptance bribes have no difference, raises the questions through the concrete case in practice and the views on the specific practices. The second part is the analysis of the constituent elements of the introducing bribe crime, so as to define the scope of the behavior of the introducing bribe crime. The third part is the theory discussion of the relationship of the behavior of the introducing bribe crime,the assisting behavior of acceptance bribes and the assisting behavior of bribery. The fourth part is through the analysis of the specific cases in practice proved to be limited by the behavior of the introducing bribe crime, can better solve the problems in the practice.
