Research On The Changes Of “Investment” Of Jurisdiction Of ICSID And China’s Measures

The definition of "investment" was broadly or limited interpreted in the ICSID arbitral tribunal practice in recent years. This article will study the provisions of the ICSID jurisdiction in the Convention on the Settlement of Investment Disputes between States and Nationals of Other States as a starting point. Combined with the practice and academic research of ICSID arbitral tribunal for recent years, this paper will analysis the changes of "investment" of jurisiction of ICSID and derive inspiration or warning significance for China.This paper introduces the concept and elements of ICSID jurisdiction at first. Then the key section of this article analyses many cases in which ICSID arbitral tribunal expanded or limited its jurisdiction. The last bou not least, this article proposes the measures which our country should to deal with the expansion and limited of ICSID′s jurisdiction.
