In recent years, the strength and scale of people on the marine environment and resources development and utilization is increasing,especially in marine, coastal engineering. We can see that, it meets the need of economic development and social progress,But it also leads to a series of marine ecological environment problem,such as inshore water quality decline,red tide disasters, sea level rise,in return,formed a serious restriction to the further expand of current economy and sustainable development of society.China attaches great importance to the legislative work of the marine ecological environment restoration and protection,after decades of efforts,in the "marine environmental protection law", "wild animal protection law", "Fishing law" mainly, other administrative regulations, local regulations, rules and regulations as a supplement, to the environmental protection department as a guide, to the various functional departments complement,setting up the system of laws and policies of marine ecological environment control.However, in its governance effect, certain results achieved in the short term, in the local place, but the overall situation of the marine ecological environment is worrying, even with a worsening trend.Investigate its reason, the control system of marine ecological environment is short of economic stimulus ways, can not effectively use the economic lever.Marine ecological compensation legislation is still in its infancy.Research shows that, adding specialized marine ecological compensation into the legal provisions, can rapidly improve the marine ecological environment control effect, is an important way to realize the protection of the ecological environment, and also is the substance of the marine ecological environment policy and law system.Because of this, this paper will follow the research ideas and methods of put forward the questions, analyze problems, to solve the problem,basing on the relevant theoretical research, combining with the development of marine ecological compensation practice,is divided into four parts to elaborate on the marine ecological compensation legislation present situation, problems and further improving measures.The first part,mainly analysis the basic theory.Through the research on the ecological compensation, marine ecological compensation, marine ecological compensation law and other related concepts and content, deepen the understanding of the connotation and extension of these concepts, and puts forward the significance of marine ecological compensation legislation, laid the theoretical foundation of the following parts.The second part, is the section.of put forward and analyze the problem.Focuses on the policy development of our country’s marine ecological compensation,the present situation of the legislation and pilot,and through the contradiction analysis of on the marine ecological compensation legal policy and practice of the status quo, pointed out the problems of marine ecological compensation legislation in china.The third part is about the experience.Through the analysis of legislation and practice situation of more mature ecological compensation fields in China, such as environmental protection,forestry, river basin water environment, providing experience to the marine ecological compensation legislation, with a view to provide guidance to its further improvement.The fourth part, is the problem-solving part, and the core of this paper.Based on the in-depth analysis of marine ecological compensation legislation,combined with the experimental work situation of marine ecological compensation in China, learn from the advanced experience at home and abroad,mainly put forward the marine ecological compensation legislation perfect suggestion in five aspects:the legislative principle, legislative style choice, the legislative process, legislative content and the supervision and control of funds, in order to reach the purposes and objectives of the protection of the marine environment, realize the harmony between people and the sea.
