Sinkiang is the motherland of the west, is a place inhabited by minority nationalities, the development of education in Sinkiang is often the focus of national attention, directly affects the stability of Sinkiang, and the Sinkiang area of education development has been lagging behind, education resources are very scarce, so our country has issued a lot of security in Sinkiang minority education policy. But the right to education, the right to education of Han nationality in Sinkiang area and Sinkiang area are different with respect to ethnic minorities, ethnic minority areas in Sinkiang, the protection of the right to education of the Han nationality in Sinkiang area did not get attention. And the right to education of Han nationality in Sinkiang area of the right to education and the mainland Chinese are also different, the Sinkiang area of education condition and the resources and the mainland have very big difference, and the Sinkiang area of education policy is also different from the mainland.Because of its unique culture, geography and history of the Han nationality in Sinkiang area education has its particularity, but few research on the right to education of the Han nationality in Sinkiang area. The problem of fair justice and strengthen the Han nationality in Sinkiang area of the right to education not only relates to the protection of the right to education, but also to maintain the stability of Sinkiang, ethnic unity, frontier development is very necessary. However, our current research for the issue of the right to education of Han nationality in Sinkiang rarely, through empirical analysis of the right to education of Han nationality in Sinkiang, as well as the right to education of Han nationality in Sinkiang and the mainland of China in the right to education and the right to education of Minority Nationalities in Sinkiang are compared, discussed the right to education of Han nationality in Sinkiang in urgent need of social concern and attention as well as the protection of the state, and the corresponding suggestions on how to protect the right to education of Han nationality in Sinkiang.Research on security of the Han nationality in the Sinkiang Uygur Autonomous Region the right to education includes five parts:The basic concepts and theories are introduced in the first chapter of the right to education. The right to education is a basic human right, is a constitutional right, with a universal and profitability, but also the rights and obligations of the complex. And the right to education according to different standards have different classification, analysis of different provisions of the right to education in international law and domestic law, international law that the right to education is a pure Chinese constitutional right, the right to education is the rule that rights and obligations.The second chapter examines the argument from the field. Discusses the Sinkiang education reform since the founding of new China changes, the current education situation in Sinkiang, Sinkiang Han in the face of the right to education of the minority policy of tendency; multi ethnic problems, ethnic division; Sinkiang religious influence on education and its the Han region caused by the dual emotion effect of political, economic, and cultural influence; backward brings; away from inland is located in the frontier of communication inconvenience.The third chapter talks about the differences between the Han nationality of Sinkiang the right to education and the right to education of the Han. Through the comparison of the economy, compared to historical background, comparative education policy, to clarify the Sinkiang Han in the realization of the right to education lag behind the mainland.The fourth chapter talks about the differences between the right to education of Han nationality in Sinkiang with the right to education of ethnic minorities in Sinkiang. In Sinkiang area, because of different national policies, resulting in different injustice, blindly to emphasize the rights of ethnic minorities in the weakening of rights will inevitably lead to another kind of inequality, the emergence of these differences is not conducive to the stability of Sinkiang, development.In the fifth chapter, from the three aspects of the legislative, administrative, judicial put forward on Sinkiang Han education right protection recommendations. Suggestions on perfecting the legislation system, improve the legislative lag problems caused by the special protection of the right to education, cancel to ethnic division, to improve the protection of the right to receive education administrative system, perfect the remedy of right to education system, and pointed out that when the general relief can not be solved, recommended the establishment of constitutional review system in china. Through these suggestions and improve the hope in Sinkiang Han nationality education can be fair and equitable treatment, Sinkiang’s education system more in line with the construction of Sinkiang development and the unity of all ethnic groups, to provide valuable guidance for the development of education in Sinkiang.
