"China-ROK Fisheries Agreement" is the second fisheries agreement between China and other countries after the UNCLOS become effective. It is aprovisional arrangement on fisheries issues before maritime delimitation completed. The Agreement formulates the management requirements of the following five areas:EEZ,South Korea provisional measures waters, transitional waters, areas which maintain the status quo and the special waters.The most important part of the Agreement is the management of fishing-boat in EEZ.The Agreements came into effect on June 30,2001, and has been implemented for 13 years. It plays an active role in the construction of a new international fishery order.However, there are also many negative effects.For example,the Korea Coast Guard detain Chinese fishermen frequently.I write this paper by the methods of field research,analysis, comparative, generalization and summarization.lconsulted the fisheries statistics, papers and books on the Agreementand the Meeting Minutes of China-ROK fisheriesnegotiations,compared the fishery data over the years.The conclusion is that the license number of Chinese fishing boat into South Korean EEZcame down year by year but the actual number increasing yearly.However, only a little number of South Koreanfishing boatcome into our waters and the number is decreasing yearly.On base of the data the article pointed out the influence after the Agreement implemented:A large number of Chinese fishing boats dropped out of traditional fishing ground.Chinese fishery has been greatly affected. The number of fishing dispute between the two countries is increasing.The article also pointed out the causes of these adverse effects:The Agreements do not fully considers the fishermen’s rights. The other reasons are the decline of inshore fisheryresource,unreasonablefishery structure,weak management infrastructure,imperfect institution and mechanism, uneducated fishermen and crude Korean policemen. At last, the article made the following policy recommendations to implementthe Agreement successfully for the future:(1)Toprotectthe coastal resources and adjust fisheris structural;(2)To take the initiative in the negotiations;(3)To train and educate Fishermen;(4)To focus on solving the IUU issue;(5) To help self-regulatory organization make up of fishermen;(6)To Enhance emergency response capabilities when emergencies occur.
