Today, China’s rapid economic development, the full take-off, urban economic development as the key carrier, collect economic center, urban planning is one of the necessary means, so urban demolition is to enable governments around the world, the past unreasonable urban housing settings transformation, create a better urban environment, it is clear that must be in the urbanization process must be carried out. However, during the practical operation, the demolition encountered a variety of complex problems.Pulled into social and public interests of the tedious process of urban demolition, the demolition, demolition and other multi stakeholder, also relates to criminal, administrative and civil many legal relationship, and is related to the demolition of the civil and property rights, constitutional basic rights of a number of rights.For a long time, many problems appeared in the process of demolition administrative regulations had a significant influence on the people legitimate rights and interests, social public interests and the national interests, is the fundamental reason for judicial review, administrative remedy, administrative legislation, there are many problems, however, the most critical is the lack of public interest defined, identified and implemented, even to the public interest in urban housing levy improvement and practice.Therefore, the meaning of the subject in urban housing demolition perspective, and to explore the public interests in administrative law of the people’s Republic of China, and in China in the name of public interest in urban housing levy existing problems, especially on the administrative law in the public interest in the preliminary discussion on the construction of urban housing expropriation system.
