Research On The Legal System Of Ecological Environment Water

Water is the Source of Life, is human survival, basic resources can not be replaced, it is also an important element of China’s national economy to maintain sustained, healthy, harmonious development. Eco environmental water consumption is a new field of research, is the important ecological system identified according to certain legal procedures such as a river, lake or wetlands the minimum required quantity and appropriate quality of water. At present, with the continuous spread of the concept of sustainable development and the scarcity of water resources crisis continues to popular, all the countries in the world are different measures are taken to protect water resources to promote and realize the sustainable development. Ecological and environmental water use in China has just started, and the water ecological environment of legal system is not perfect, therefore, must pay attention to the research on the water ecological environment, establish and perfect the legal system of ecological and environmental water. Compared with China, many foreign countries the legal system of water ecological environment has been improved, therefore, makes a comparative study on the ecological environment of water law and policy on the ecological environment of foreign water law system, is of great significance and value in our country.Firstly, the concepts related to the ecological environment of water carried out a detailed definition. On this basis, summarized the theoretical basis of the ecological environment of water, including the ecology center doctrine, the concept of sustainable development and ecological holism. Secondly, guided by the concept of sustainable development, starting from the ecological holism, this paper probes into the current situation and problems of China’s ecological environment water. Mainly includes five aspects: the legal status of the ecological environment of water lack the advanced legislation guiding ideology, the ecological environment of water is not clear, the ecological environment of water in water resource allocation system in order of priority, the ecological environment of water to determine the specific measures for the protection of the lack of specific procedures or rules or methods, water ecological environment is not perfect. Through analysis of the status quo, the comparison of foreign ecological and environmental water, makes a comparative study from six aspects of water resources allocation system structure, whether the specific measures for the protection of the ecological environment of water, clear recognition of the ecological environment of water priority, ecological and environmental water, water ecological environment and the ecological environment water law and policy lessons, general in order to show the content of ecological and environmental water system, put forward the experience for our country ecological environment water. Finally, through the research above, in view of our country water ecological environment problems and the insufficiency, puts forward five suggestions. Including the establishment of the guiding ideology, the ecological environment of water right, improve the legal status of ecological water use in China. The ecological environment of water in water resource allocation system structure in the order, make sure the important ecological system ecological region or minimum water procedures, rules or methods, improve the ecological environment of the specific measures for the protection of water.
