Research On Juvenile Criminal Procedure Rights Security

In recent years, our country minor crime has become increasingly serious and has become an urgent problem to be solved. Through the judicial relief way to guarantee the legitimate rights and interests of minors should be more attach importance to it. With the juvenile crime rate more and more high, how to through the judicial process to protect their litigation rights extremely is important.The juvenile defendant litigation rights protection affects the healthy growth of minors themselves and the development in the future,related to the happiness and stability of the involved minors’ family, related to the future hope of the nation. In 2012,a chapter in the new criminal procedure law in juvenile criminal proceedings is a great progress of legislation in our country. However, through the theoretical study on the protection of the rights of minors and the comparative analysis to the provisions of the protection of the rights of minors abroad, and combining with the judicial practice, it is found that the current litigation rights protection of minors in criminal cases in our country still have many deficiencies to be improved.This paper starts from the social survey system, Conditional non-prosecution system, Criminal record storage system and criminal records sealed system and analyses their shortcomings. On this basis, according to the present situation of juvenile litigation rights and relieves as well as the existing problems, and puts forward some suggestions, including: The transformation of case handling attitude in the notification system of advocacy and coherent work of public security organs and the legal aid institutions; To expand the scope of the nature of social investigation of social investigation system and a clear social investigation report; Conditional non prosecution system and other system integration; the clear legal responsibility criminal records sealed system and means of relief, and by "criminal record" sealed "towards the elimination of previous conviction". I hope these suggestions are helpful to improve the juvenile litigation rights in our country.
