Study On The System Of Post-enactment Evaluation Of Local Government Rules

The system of post-enactment evaluation of local government rules is an innovative one, although we have had a certain amount of theoretical study and practical experience, the system is still in the early stage of study and practice. This essay selects the system of post-enactment evaluation of local government rules for study, mainly adopts the survey, empirical analysis and comparative analysis those three kinds of methods for study.First chapter of this essay mainly discusses the background of selecting the title, significance of study and the current study at homeland and abroad. The second chapter carries out a scientific definition of the concept of post-enactment evaluation of local government rules, proposes post-enactment evaluation should adhere to the principles of being objective and truthful, scientific and reasonable, participation democratic, current effective. When selecting the evaluation objects, based on the realities of local government rules enactment, only rules were included in the post-enactment evaluation, but from a long-term point of view, other objects should be focused on, including other administrative normative documents of abstract administrative behaviors. The third chapter discusses the subject of post-enactment evaluation of local government rules, the author thinks, a delegate subject will be more appropriate. The fourth chapter discusses the evaluation criteria, the author thinks that legitimacy, rationality, effectiveness, coordination, enactment technology are the important parts of constructing the system of evaluation criteria. The fifth chapter discusses the evaluation methods of post-enactment evaluation of local government rules, in this chapter, the author spends much energy in the construction of evaluation methods, the author thinks that the evaluation should combine the subjective principle with objective principle, according to the evaluation purpose, evaluation object, evaluation criteria and so on to choose the suitable evaluation methods. The sixth chapter discusses the evaluation procedures of post-enactment evaluation of local government rules, through analyzing domestic and foreign evaluation procedures, it will perfect the evaluation procedures gradually. The author thinks the evaluation procedures should divided into the general procedure and the simple procedure to analyze. The seventh chapter discusses the application of the results of post-enactment evaluation of local government rules, the application of the results is after it have been fully affirmed, the proposal in the evaluation report on the improvement of local administrative enactment and enforcement can be transformed, which was discussed in this essay by using the evaluation results for the local government rules explaining, modifying, abolishing, re-establishing, and perfecting supporting system.This essay strives to study a standardized and systematic system of post-enactment evaluation of local government rules, which practice puts forward demands to the theory, and hopes it can benefit for promoting law-based administration in an all-round way, strengthening the building of a government ruled by law and a service-oriented government.
