The Value Of Confucianism Thoughts In The Late Qing Dynasty’s Law Revision

Since the last 80’s, along with China’s reforming and opening, and the process of globalization under the western developed countries’control, the western political culture, legal culture, affect deeply on China’s political system reform and the construction of modern society governed by law. However, money worship is popular, under the transition of the market economy. People now hope the whole society bring Confucian ethics and morality again. Under the dual background, the party held the eighteen session of the fourth plenary session.This tells us that our country is about to open the " Governing the country according to law" course. These urge us questioning ourselves, questioning of history, the modern law of flowers will be in highly permeable Confucian traditional China base soil in full bloom.The law revision is the Chinese historical events which can not be ignored.The collision of different legal thoughts promoted the development and modernization of legal Chinese. From the perspective of legal history, Confucianism no doubt gave spiritual nourishment to the law faction and the ethic faction. Confucianism let them not divorce from reality, not blindly advocating westernization, but repeatedly based on the proposed law claims on the national conditions. As the results in the amendments to the law of "Qing current criminal law", "new criminal law of Qing Dynasty" Confucianism also had an important position.This paper is intended to sort out the basic meaning of Confucian legal thoughts in the late Qing Dynasty, and the School of law, School of feudal ethics thought sin the late Qing Dynasty. I want to show the significance of the results of Confucian Thoughts on the law reform in the late Qing Dynasty, in order to explore the experience and lessons from it, thinking of historical reference.The first chapter of this paper will introduce the basic concepts of Confucian legal thoughts. By summarizing the main legal thoughts of Confucianism in general can help us better understand the origin of Confucianism. The second chapter of this paper mainly from the legal characters show the influence of Confucianism on law reform in the late Qing dynasty. The third chapter of this paper is to show the influence of Confucianism on law reform in the late Qing Dynasty,from the perspective of the new law text. From the final text, we can find that the "bottom line" of each factions. This is precisely the deepest part of the late Qing Dynasty. Finally, this paper will discuss the thoughts of Confucianism in the late Qing,describes objectively the role and the value in the late Qing.Discuss the enlightenment to the people.
