Lust control has been considered as a great sign distinguishing between humansand animals, and the lust was mainly controlled by the moral and legal norms. Inancient China, legal norms to classify illicit sex behavior is from the perspective ofidentity，at the same time, the public also gave illicit sex behavior moral pressure.Illicit sex between relatives is a very special kind of illicit sex crime, until now, somecountries or regions still retained it. Such stringent requirements on the behavior ofillicit sex between relatives, not only for reasons of eugenics, but also to establish afamily order.The statute of illicit sex between relatives was gradually aggravated since theTang Dynasty. During the Qing Dynasty, because of the increased population in thecommunity, women actually became a rare resource, relatives had a naturallyconvenience to outsiders. And to the women, the male relatives were the most contactmen.In this closed family environment, women and male relatives easily seduces thedark. At the moment, the Qing Dynasty whether national acts, the public opinion orthe law, tend to respect women’s chaste to a certain height. This means that thepunishment of illicit sex behavior was more aggravating than the previous dynasty,and illicit sex between relatives because of the particularity of identity, elders can notreduce penalty as in other crimes between relatives. The beginning of this article will introduce and analysis the statutes andregulations of “illicit sex between relatives” of the Qing Dynasty,then observe howlawmakers regulated all the circumstances of illicit sex between relatives. Chapter IIof this article will classify cases of illicit sex between relatives, for case analysis onecan see real individual behavior, and morphological analysis of each category of casesin the judicial decision, we can see the social and moral values behind it. Last part ofthis article will discuss the reason of the change of the statutes of “illicit sex betweenrelatives”.
