The Academic History Of Chinese Legal History(1949-1978)

The modern discipline of Chinese Legal History was born in the end of Qing Dynasty.At the beginning of 20 th Century, under the influence of western, tradition Chinese academic system was transformed into modern academic system. The modern discipline of Chinese Legal History was built. From 1902 to 1949, the Chinese Legal History had gone through a change of nearly half a century.To the discipline of Chinese legal history, the years from 1949 to 1978 were a hard time. The thesis is the research of Chinese legal history in this period as the research object. By studying the Chinese Legal History’s results events debates characters and institutions, the thesis describe the full scenery of Chinese Legal History research in this period. At the same time, The thesis uses the method of comparison to conclude the characteristic and the reflection of Chinese Legal History research of this period.The thesis has three major sections: Introduction, Main Body and Conclusion.The Introduction is divided into three parts: the Significance of Topic, the Literature Review and the Research Methods.The Introduction is mainly talking about the the main direction of the thesis, the literature search and the research method, while The Conclusion is a summary of the whole thesis.The Main Body of thesis is divided into six chapters. Chapter 1 is about the stage of the development of Chinese Legal History. It is mainly talking about stages’ divide and characteristic of the research of Chinese Legal History in China Mainland from 1949 to 1978.Chapter 2 and 3 is about the research results of the research of Chinese Legal History in China Mainland from 1949 to 1978. The results include six parts: the research of the discipline, the research of general history of Chinese legal system, the research of the history of department law, the research of minority nation’s law and the research of chronological history of Chinese law.Chapter 4 is about the events and debates of the research of Chinese Legal History in China Mainland from 1949 to 1978. This Chapter mainly describe the process and effect of these events and debates.Chapter 5 is about the characters and research institutions of Chinese Legal History in China Mainland from 1949 to 1978. On the research of characters, this thesis mainly adopts the methods of population studies, the overall analysis of the features of legal history research groups Chinese mainland area during this period. Research institutions are mainly around the typical research, analysis of the role of these institutions in the Chinese legal history teaching and research.Chapter 6 is about the characteristics and reflection of Chinese Legal History.By comparing with the studying in 1980 s the thesis sums up the characteristics and reflection of the studying of Chinese Legal History in this period.
